Please read these Terms and Conditions carefully before using our Website or any service we provide.

By registering on the Website, using the website, or in any way using our services including registering over the phone you, the Player, accept and agree to these Terms and Conditions and the Privacy Policy.
The Terms and Conditions and the Privacy Policy may be changed at any time without notice and will be active immediately.
You will be notified of any changes via email. If you do not agree to any terms or conditions then do not use our services or Site.

LottoBundle runs lottery syndicates where multiple people signup to a syndicate and share any winnings that that syndicate may get. We in no way are linked to any Lottery company and are not connected with Camelot Group PLC, The National Lottery Commission or Services aux Loteries en Europe operators of the EuroMillions Lottery or any other betting facility providers other than through the normal course of business.

Headings in this document shall not affect the construction or interpretation of these Terms & Conditions.

Definitions

“Registering” - Entering your details and registering to get either a free or paid account with us.
“you”, ”the player”, ”player”, ”user”, “users” “member” - is the individual who has registered to use our services.
“We” , ”us”, ”our”, ”the company”, ””, ”LottoBundle”, ”LottoBundle” - refers to us, the company .
“Syndicate” – a group of players who have lottery tickets, line entries games or draws assigned to the group of players where any winnings are split between the members.

“Camelot Group” or “CG” - the organisation that organises the official UK National Lottery (herein ”UK National Lottery“) among others.
“The Site”, “website” or “Site” refers to LottoBundle, owned and operated by Us.
“Services” the organisation and management of syndicate groups
“Account” means the user portal area of the Website, unique to a Player
"Dormant Account": means an account that has not been accessed for a period of three months, at which point we may cancel your account.
"Membership Fee" means a regular recurring payment required to use one or many of our services, mainly joining a syndicate.
“The Company” provides facilities for the playing of games of chance for a prize; your Membership Fee gives a Contractual Right to share in a Syndicate winnings where you are assigned and part of that syndicate.
“ID Information” means information used to establish the identity of a Player, which includes, but is not limited to, inspection of the Player's passport, driver’s license etc
“Syndicate Organiser” means a representative of Us who is an additional member of a Syndicate to the Player Members.
“Winnings” means any monies won by a Syndicate in any Game, after (if applicable) any deduction for tax and administration fees.
“Minimum Winnings” is the minimum share of any syndicate winnings before they are paid out to you. These are displayed in your personal portal area (your “account”). Unless stated other wise the minimum amount of money where you won’t be charged for transferring the money to you is £50.
“Personal Portal” This is the secure unique portal which you can securely log into to check your share of any winnings and lottery numbers.

Below is some very important key information about Us and the services we provide.

LottoBundle is a lottery Syndicate Organiser.
We are not a gambling or gaming Company and therefore do not require a license from the UK Gambling Commission.
We do not promote a lottery and are not lottery promoters
We do not require a lottery operating license
We comply fully with these regulations found on the Gambling Commission website.
A Syndicate does not amount to joining a collective investment scheme.

Joining a Syndicate and using any of our services or playing any game through our site or services there is no guarantee of receiving any Winnings and we in no way do we guarantee you any return on any fees we charge.
Please note, we provide lottery syndicates only. We do not sell lottery tickets.
As we purchase tickets based on current members, if you join any syndicate for any specific draw you must join 24 hours in advance of the draw time. This includes any special promotional syndicates. This gives us enough time to organise and assign you to a syndicate.

If you purchase or join a syndicate on a day of a draw you will default to the following draw date. For example if you join to play the Tuesday draws on Tuesday, you will be entered into a syndicate for the following Tuesday. If you need any clarification on this please do not join or redeem any voucher but instead get in contact.

General Information
The Site provides information about different lotteries and enables registered Site users to purchase a place in one or multiple pre-organised lottery Syndicate(s) all in accordance with these Terms & Conditions.
This document explains how the agreement is made up, and sets out the terms of that agreement. These terms and conditions form a legally binding agreement between you and Us in relation to your use of the Services we provide.

Cookies
We use cookie technology across our sites. It places cookies on any device such as your PC, Laptop or other devices to allow us provide a better service to you.

We use Google Analytics, you can find out more about their tracking and cookies by googling them. We also use other third party analytical providers and may add some of our own.

Restrictions of use
You may not use the Services and may not accept the Terms if

(a) you are not of legal age to form a binding contract with Us, or play any lottery games.

(b) you are legally not allowed to use our services based on laws of the country in which you are resident or from which you use the Services.

Identification
We reserve the right to ask for proof of identity at any time including proof of age and residence. Failure to provide substantiated evidence will result in the suspension of your Account. Any monies or Winnings due or requested during this time will be withheld by us until the requested ID Information is provided.

Signing up and registering
You can register to use our service and have an Account either online or over the phone. By registering we are collecting your details. You will be placed in a free account or a paying account. A free account is when you are part of a syndicate but it may be a free promotional account where there is no fee. A full account or paying account is once you are a paying member and pay a recurring subscription. Promotional accounts are not always recurring and can be cancelled at any time without notice.

You must not give anyone else access to your private login area nor access to your secure login details. We accept no liability for any use of your account. If a third party has accessed your Account, we accept no liability for any monies or information lost, changed or misused.

We reserve the right to refuse to register you

Termination
We reserve the right to suspend and or terminate your Account at any time at our sole discretion. We are not obliged to provide you with any reasons for doing so.

Upon termination by either party you will not be due any monies or winnings, you will not receive a refund and you will be removed from any syndicate(s) that you where previously assigned to.

Winnings and monies
We reserve the right to hold any payment of monies into your Account or to you if there is manipulation suspicion, or evidence, of a breach these terms and conditions that govern your use of our service or the site.

Our Syndicate services enables multiple users to join a syndicate with a given number of Lottery Draws assigned to it and to share in any Prize which may be due if such Syndicates contains Winning Lottery entries or tickets. By using our service if the syndicate you are assigned to wins any money you will get a share while you are still a member of that syndicate.

By paying to use our service, you will not own any specific Lottery Ticket or Line purchased for the Syndicate. Any incomplete groups of syndicates the company will retain the spare places.

Your part of any winnings are also referred to as the Syndicate Prize Share. This is the portion or share of the winnings due to you for being part of a syndicate which had a winning lottery ticket assigned to it. Your share is calculated by the winnings divided by the total number of places within a syndicate.

Winnings after any tax, (if applicable) has been deducted will be distributed to Members of a Syndicate which has won the prize as soon as possible after receipt of cleared funds from the lottery operator. Winnings may take a while to process depending on the size of the winnings but in any case we will attempt to transfer the monies due within 30 days.

For the avoidance of doubt if we, the company, does not receive the winnings from the lottery operator and after we have exhausted all reasonable efforts, are still unable to obtain the winnings for whatever reason, we, or any parent companies, subsidiaries, officers, directors, shareholders and employees or any other connected parties do not accept any liability whatsoever from any and all claims, losses, liabilities, demands, damages, costs, or expenses. In an instance where winnings can’t be claimed, as a measure of good faith we will refund your last payment made to us.

Share of any winnings will be either credited to a Credit or Debit Card in the name used to open your Account or to another bank account. Depending on which route we, the company, decides to take.

Should an alternative method of payment for their percentage of any Winnings be requested by a Member it will be at the discretion of the Company.

We reserve the right to refuse a request to transfer funds from or to certain countries or jurisdictions as we may dictate from time to time.

Prior to your share of the winnings being transferred all Winnings are subject to there being a minimum amount due to a Syndicate member of £50, unless the member requests a payment to be made at the time of closing their account of which there is a £10 fee.

If a member does not claim or request any share of winnings to be deposited/transferred to them and their account is closed or dormant then the company will hold the winnings for a period of 6 months. If they are still not claimed and the company will retain the winnings indefinitely for use of how the company feels fit.

Notifications
Written notice can mean by e-mail, to the email address you have provided to us, or by a notification on the Website.

We are not responsible for any communication which we send and you don’t receive or you send and we don’t receive. Communication could be in the form of a letter, SMS, email or other.

Payment
You agree that we may automatically debit your Credit / Debit card in connection with using our Service (Recurring payments). If a payment fails we retain the right to make further attempts to take payment for up to 30 days after the initial failed payment. If we cannot collect your membership fee your account will be immediately suspended and you will not participate in any syndicates until you have made payment.

Some Credit or Debit Card providers may charge you for the use of their Card. We do not accept any responsibility whatsoever for such a charge being made.

You may also be due to pay any payment processing fees which we may occur. You will be notified of these charges upon signing up to use our service.

Term and Cancellation
If you cancel this service within the first 12 months you may be liable to pay a £15 admin fee.

At any point and for any reason we may terminate your use of our services. You may not be due any refund.

Once you have made payment management of your syndicate, organising draw numbers and purchasing tickets starts immediately. Therefor you are unable to cancel your membership for the period in which you have paid the first membership Fee. By agreeing to these terms and conditions you accept that your right to cancel your Membership under the Consumer Protection (Distance Selling) Regulations 2000 shall not apply.

In all cases by using our services you accept that no refund will be due if you where to cancel.

To cancel you must write to us via post or email. Upon receiving your cancelation request we will terminate your account immediately. Any winnings/monies owed will be paid out. If they do not meet our minimum winnings amount then you will be due to pay us £10 for transferring any share of winnings.
By registering over the phone you may be given a 7 day period to check these terms and conditions prior to any payment being taken. This is to give you time to be happy with the service prior to us putting you in a participating syndicate.

Syndicates
Each Syndicate has a set number of members plus one Syndicate organiser. The number of members per syndicate may change. You will be notified if the number of players in your syndicate changes.

Free syndicates and free syndicate promotional offers and any syndicate which you do not have to pay to join may have more members than standard syndicates, the total number of members is of the discretion of the company.

Unless otherwise stated all other syndicates will have 100 members plus an additional Syndicate Organiser appointed by the Company who shall form part of the Syndicate.

Draw numbers applicable and assigned to your Syndicate will be made available to you from the log in page of your Account

For the avoidance of doubt no tickets are purchased in the name of, or on behalf of a Member.

The Company together with the Syndicate Organiser forms a contractual relationship between the parties, and the other members of the Syndicate to ensure that any Winnings after deduction of any applicable costs, are divided equally between the Members of a Syndicate.

Tax
At the time of these terms being created all prizes won from UK lottery tickets sold in the United Kingdom & the Isle of Man are tax free. Other countries may be subject to local taxes in the jurisdiction of the Lottery Operator. We have no control over any tax legislation (nor changes in tax) in any jurisdiction and therefore cannot be held responsible for any reduction in prize winnings due to part of the winnings paying any admin or tax fees.

Special Draws, Promotional games and offers
At any time we may offer or promote other games, draws or syndicates. These will have standalone terms which may have additional terms to the terms found within this document.

For any draws, prizes or competitions where a non monetary prize is won, for example a holiday which can not be shared between members another draw, game or ticket will be purchased in it’s place.

Special Promotions / Wowcher coupons / Living social coupons

Each special promotion has their own additions to our standard terms and conditions. Points within this section overrule any contradictory term within these terms and conditions.

Due to the low cost of the coupons all 'Wowcher' and 'Living Social' syndicate groups will only get a share of any Jackpot or the top scratch card payouts, these top prizes will then be shared among the syndicates. The amount of members within any related 'Wowcher' and 'Living Social' syndicate is dependent on the amount of people who purchase a 'Wowcher' and 'Living Social' coupon.

If you purchase a voucher you must redeem it the day before the draws you want to play in. This allows us enough time to organise the syndicate you will be in.

Warranty, Liability, Indemnification & Disclaimers
The site is provided on an "as is" and "as available" basis, and without warranties of any kind whether expressed or implied. We do not guarantee that the site will be free of security breaches, hacks or virus attacks.

We do not make any representation or warranty regarding your chance of obtaining winning numbers or of being entitled to a prize and we do not guarantee that a lottery operator will perform any lottery draw, honour a lottery ticket and/or, pay prizes.

Your participation in each lottery draw and any of our services is voluntary and at your sole risk and discretion. You agree that we are not liable for any claims or damages arising out of or connected with any loss of earnings, damages, unpaid share of winnings due to any lottery operator

If at any point tickets are unable to be purchased, miss placed or lost then that particular lottery draw will be excluded from the syndicate and you will be due a refund for that draw. For example if the syndicate you are a member of has a draw on a Friday assigned to it, and the assigned tickets for that draw are not purchased you will get a refund for that draw. The refund is equal to the membership fee you have paid for that period divided by the number of tickets purchased for the syndicate for that period. As an illustrative example only: You pay a £1 membership fee for a week, there are 10 tickets assigned to the syndicate for that week, £1 divided by 10 = £0.10 due as a refund. This is only the case if tickets are not purchased (or lost) due to any human, technical error or other error

Information on this Website may be out of date or inaccurate. Information or the service may be changed or updated without notice.

IN NO CIRCUMSTANCE WILL THE COMPANY BE LIABLE TO ANY PARTY FOR ANY DIRECT, INDIRECT OR OTHER CONSEQUENTIAL DAMAGES OR LOSSES WITHOUT LIMITATION. THIS INCLUDES THE EVENT OF ANY INCORRECT ACQUISITION OF SYNDICATE NUMBERS OR LINE ENTRIES RESULTING IN A LOSS OF PRIZE MONEY.

You, The Player agrees to indemnify, defend and hold harmless Us, the Company, and its parent companies, subsidiaries, officers, directors, shareholders, employees, and partners from any and all claims, losses, liabilities, demands, damages, costs, or expenses (including reasonable legal fees), arising from or asserted by any third party.

Force Majeure
We, The Company shall not be liable for any delay or failure to perform our duties or service we provide due to any unforeseen circumstance including but not limited, fire, flood, strikes, lock-outs, hardware, software, computer, internet, virus/cyber attacks or any government action.

Playing by mobile
From time to time we may send you an SMS (text message) to your mobile phone. Informing you about any up coming special offers. You may have the option to join that offer by replying to a text. You may be charged for the text, the charges will be displayed to you.

We are not liable for any costs or charges if a third party uses your mobile phone whatsoever

Invalid Clauses
Should any part of any terms and conditions or privacy document on the site be found by any court to be illegal, void or unenforceable, then that part shall be deemed not to be a part of the terms and conditions and the enforceability of the remainder of the terms and conditions shall remain in affect.

Law
The terms and conditions shall be governed by and construed in accordance with English law.

By using our website and services you agree to these terms and conditions and therefor agree that the Courts of England shall have full jurisdiction to settle any dispute which may arise out of, under or in any connection with these terms and conditions or the service we provide. We retain the right to bring proceedings against you for breach of these terms and conditions in your country of residence or any other relevant country we may require to do so in.

Change of services
We may at any point be unable to purchase tickets, a lottery may stop selling tickets, ticket and draw prices may change or simply we want to change the lottery draws we purchase tickets from therefor we reserve the right without prior notice or liability, to provide any other type of alternative legally licensed lottery draw.

Use of your information
By entering your details on our site or giving us your personal information in any way including but not limited to over the phone, by SMS, via email, via post, via our website you consent to receiving promotional offers from us, and other carefully selected third party companies. You also agree to the Terms and Conditions of the Privacy Policy statement.
